Early this week, the federal court in San Francisco today denied FTC’s appeal to put Microsoft’s Activision Blizzard appeal on hold. As expected, today the FTC filed its appeal of the decision to federal appellate court.

Notice is hereby given that Plaintiff Federal Trade Commission (“FTC”) appeals to the United
States Court of Appeals for the Ninth Circuit from this Court’s Opinion dated July 10, 2023 and entered on the Court’s docket on July 11, 2023 at ECF Docket Number 305 denying the FTC’s request for a preliminary injunction pursuant to Federal Trade Commission Act § 13(b), 15 U.S.C. 53(b).

“Yesterday the Court ruled our acquisition of Activision Blizzard should proceed, and we oppose any further delay”, said Brad Smith, President at Microsoft. He offered the following statement regarding FTC’s appeal:

The District Court’s ruling makes crystal clear that this acquisition is good for both competition and consumers. We’re disappointed that the FTC is continuing to pursue what has become a demonstrably weak case, and we will oppose further efforts to delay the ability to move forward.
